Terms of Service
These Terms of Service ("Terms") govern your access to and use of the website at lowraudio.com (the "Site") and your purchase of products from Jared Veltkamp, doing business as LOWRaudio ("LOWRaudio," "we," "us," or "our"). By using the Site or buying a product, you agree to these Terms. If you do not agree, do not use the Site.
Your use of our software products is also governed by our End User License Agreement (EULA), and purchases are subject to our Refund Policy. Your privacy is covered by our Privacy Policy.
1. Eligibility
You must be at least 16 years old (or the age of majority where you live) and able to form a binding contract to purchase from us or use the Site.
2. The Site and our content
All content on the Site — including text, graphics, logos, audio demos, plugin interfaces, and software — is owned by LOWRaudio or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to view the Site for your personal, non-commercial use. You may not copy, reproduce, scrape, or create derivative works from the Site except as expressly permitted.
3. Accounts & license keys
When you purchase a product you may receive license keys and download access. You are responsible for keeping your license keys and any account credentials confidential and for all activity that occurs under them. Notify us promptly of any unauthorized use.
4. Orders, pricing & payment
- All prices are shown in US dollars (USD) and may change at any time. The price that applies to your order is the one displayed at checkout.
- Promotional or launch pricing is available only for the period and on the terms stated.
- You are responsible for any applicable taxes, which may be added at checkout depending on your location.
- Payment is processed by our third-party payment provider. By placing an order you authorize us (or our provider) to charge your payment method for the total amount.
- We may refuse or cancel an order if we suspect fraud, an error in pricing, or a violation of these Terms.
5. Digital delivery
Our products are delivered digitally. After successful payment you will receive access to download the product and any license keys. It is your responsibility to ensure your system meets the stated requirements before purchasing.
6. Refunds
Because our products are digital downloads, refunds are governed by our Refund Policy, which forms part of these Terms. Please read it before you buy.
7. Acceptable use
You agree not to:
- use the Site or products for any unlawful purpose;
- copy, distribute, resell, sublicense, or share license keys except as the EULA allows;
- reverse engineer, decompile, or attempt to extract source code except where the law expressly permits;
- interfere with or disrupt the Site, or attempt to gain unauthorized access to our systems; or
- use automated means to scrape or harvest data from the Site without our written permission.
8. Third-party services & links
The Site may link to or rely on third-party services (such as payment, email, or hosting providers). We are not responsible for the content or practices of third parties, and your use of their services is subject to their own terms.
9. Disclaimer of warranties
The Site and products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Site or products will be uninterrupted, error-free, or compatible with every system or DAW.
10. Limitation of liability
To the maximum extent permitted by law, LOWRaudio and its owners and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Site or products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Nothing in these Terms limits liability that cannot be limited by law, and these limits do not affect the statutory rights of consumers.
11. Indemnification
You agree to indemnify and hold harmless LOWRaudio from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site or products.
12. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted here with a new "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The courts located in California will have jurisdiction over any dispute, except where applicable consumer-protection law gives you the right to bring proceedings in your country of residence.
